NOTICE OF FINANCIAL INCENTIVE - JMX LOYALTY 

JMX offers a voluntary loyalty and referral program called JMX Loyalty. The program allows eligible customers to earn JMX Points, redeem rewards, qualify for loyalty tiers, receive referral benefits, and participate in other promotional opportunities.

Because JMX Loyalty provides discounts, points, free products, tier benefits, and other rewards in connection with the collection and use of personal information, the program may be considered a financial incentive or price or service difference under California law.

Participation in JMX Loyalty is voluntary. You may purchase products from JMX without joining the program.

Summary and Material Terms

JMX Loyalty currently allows eligible members to receive benefits that may include:

• 25 JMX Points as a one-time enrollment reward

• Points based on eligible merchandise purchases after discounts and before taxes and shipping

• 20 points for an eligible verified written review, subject to a maximum of 40 review points per order

• 100 points after an eligible referred customer completes a qualifying order and the order is approved

• 50 birthday points once per year when an eligible member voluntarily provides their birth month and day

• Purchase discounts obtained by redeeming points

• Designated free-product rewards

• Loyalty-tier status and accelerated point earning at certain tiers

Current purchase-earning rates are:

• Thrive: 1 point per eligible $1 spent

• Flourish: 1 point per eligible $1 spent

• Radiance: 1.25 points per eligible $1 spent

• Icon: 1.5 points per eligible $1 spent

Current tier thresholds are based on qualifying merchandise spending during a rolling 12-month period:

• Thrive begins at $0

• Flourish begins at $300

• Radiance begins at $750

• Icon begins at $1,500

The current base cash-reward conversion is 100 points for $5 off an eligible purchase. Additional amounts may be redeemed in 100-point increments.

The current minimum eligible merchandise subtotal is $34 for every $5 redeemed. For example:

• A $5 reward requires at least $34 in eligible merchandise

• A $10 reward requires at least $68 in eligible merchandise

• A $15 reward requires at least $102 in eligible merchandise

• A $20 reward requires at least $136 in eligible merchandise

Cash-reward codes generally expire 60 days after they are issued.

Current free-product rewards may include:

• 400 points for Adaptogen Immunity Drops

• 600 points for Colostrum Powder

• 800 points for NAD+ Cellular Support

Each designated free-product reward is limited to one redemption per eligible member during each 365-day period and remains subject to availability. Shipping charges, taxes, duties, and other applicable charges may still apply.

Under the referral program, an eligible new customer may receive 10% off a first qualifying order containing at least $40 in eligible merchandise. The referral discount generally expires 30 days after issuance.

The referring member may receive 100 points after the eligible referred order is completed and approved. Purchase and referral points are generally subject to a seven-day approval period.

JMX Points expire after 12 months without qualifying loyalty activity. Earning or redeeming points generally resets the expiration period for the member’s remaining point balance.

Unless JMX expressly states otherwise, loyalty rewards cannot be combined with other order, product, shipping, subscription, referral, promotional, or loyalty discounts.

All program benefits remain subject to eligibility requirements, qualifying activities, point balances, product availability, purchase minimums, approval periods, expiration periods, redemption limits, fraud review, and the JMX Loyalty Program Terms.

Personal Information Involved

Depending on how you participate in JMX Loyalty, we may collect or use the following categories of personal information:

• Identifiers and contact information, such as your name, email address, mailing address, customer-account information, loyalty identifier, referral identifier, IP address, and device identifiers

• Commercial and transaction information, such as your purchase history, products purchased, eligible spending, subscriptions, discounts, returns, refunds, cancellations, and payment status

• Loyalty information, such as points earned or redeemed, point balances, pending points, rewards, reward codes, tier status, qualifying tier spending, and program activity

• Referral information, such as referral links, referral attribution, referral-reward status, and the eligibility of referred purchases

• Review information, such as verified written reviews, products reviewed, and qualifying orders associated with reviews

• Birthday information, consisting of the birth month and day that you voluntarily provide for an annual birthday reward

• Internet and electronic activity, including interactions with our website, customer account, loyalty features, referral links, emails, and program content

• Preferences and inferences derived from purchase history, loyalty activity, product interests, reward use, and engagement with JMX

We may use this information to operate JMX Loyalty, calculate points and tiers, issue rewards, process referrals, verify eligible reviews, personalize customer experiences, prevent fraud and abuse, communicate with members, and analyze and improve the program.

We may disclose this information to service providers that assist with ecommerce, customer accounts, loyalty administration, referrals, reviews, communications, analytics, payment processing, fraud prevention, shipping, and order fulfillment, as described elsewhere in this Privacy Policy.

How to Opt In

You may voluntarily opt in to JMX Loyalty by enrolling through the JMX Loyalty page, creating or signing into an eligible customer account and selecting the option to join, completing a loyalty enrollment form, or using another clearly presented enrollment method.

By enrolling, you request participation in JMX Loyalty and acknowledge the collection and use of personal information as described in this Privacy Policy and the JMX Loyalty Program Terms.

No purchase is required to join JMX Loyalty, although certain points and benefits require an eligible purchase or qualifying activity.

Right to Withdraw

You may withdraw from JMX Loyalty at any time by contacting JMX Support at:

Please provide the name and email address associated with your loyalty account so that we can identify the correct account. We may request reasonable verification before processing your request.

After your withdrawal is processed:

• Your participation in JMX Loyalty will end

• You will no longer earn new loyalty points or benefits

• Pending or unused points may be canceled

• Unredeemed rewards may be canceled

• Loyalty-tier status and referral benefits may be canceled

• You may lose access to other program-related benefits

Withdrawing from JMX Loyalty does not automatically cancel an order, subscription, purchase, or general JMX customer account.

Withdrawal also does not automatically delete personal information that we are permitted or required to retain for transaction records, legal compliance, fraud prevention, accounting, taxes, dispute resolution, or other purposes described in this Privacy Policy.

You may separately submit a privacy request as described in the Your Rights and Choices section of this Privacy Policy.

Good-Faith Estimate of the Value of Personal Information

The value of personal information associated with JMX Loyalty varies according to a member’s purchases, loyalty activity, referrals, reviews, reward redemptions, tier status, and length of participation. There is therefore no single fixed value applicable to every member.

As a good-faith estimate, JMX considers the value of personal information associated with JMX Loyalty to be reasonably related to the value of the points, discounts, free products, tier benefits, referral benefits, and other program benefits made available to or used by the member.

At the current redemption rate of 100 points for $5:

• Purchase-earned points at the Thrive and Flourish tiers have a potential redemption value equal to approximately 5% of eligible merchandise spending

• Purchase-earned points at the Radiance tier have a potential redemption value equal to approximately 6.25% of eligible merchandise spending

• Purchase-earned points at the Icon tier have a potential redemption value equal to approximately 7.5% of eligible merchandise spending

At the same redemption rate:

• The 25-point enrollment reward has a potential value of approximately $1.25

• The 20-point verified-review reward has a potential value of approximately $1.00

• The 50-point birthday reward has a potential value of approximately $2.50

• The 100-point referral reward has a potential value of approximately $5.00

Free-product rewards and other promotional benefits may provide additional value. Their value may depend on the applicable product, retail price, availability, shipping charges, taxes, redemption requirements, and other program conditions.

A member who does not earn or redeem a benefit may receive no realized monetary value. A member who actively participates may receive value equal to the discounts, products, points, and other benefits actually made available to or used by that member.

Method Used to Estimate the Value

JMX uses a reasonable, good-faith method to estimate the value of personal information associated with JMX Loyalty.

The method considers, as applicable:

• The redemption value of points and discounts

• The retail value and direct cost of free-product rewards

• The value of enrollment, birthday, review, referral, promotional, and tier benefits

• The percentage of issued points and rewards that members redeem

• The average qualifying purchases and participation of loyalty members

• Technology, software, service-provider, administrative, customer-support, fraud-prevention, fulfillment, and program-development costs

• The reasonably anticipated value to JMX of customer retention, repeat purchases, referrals, reviews, engagement, and an improved understanding of customer preferences

Because JMX Loyalty is a new program and participation will differ among members, JMX may initially rely on the stated reward values, anticipated participation, projected program expenses, and reasonably expected business benefits. JMX may update its estimate as actual program information becomes available.

JMX has determined in good faith that the benefits offered through JMX Loyalty are reasonably related to the value of the personal information associated with participation in the program.

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you.
