OVERVIEW
Welcome to JMX.
These Terms of Service and Sale, together with any policies and additional terms referenced within them, are referred to collectively as the “Terms.”
These Terms form an agreement between you and JMX Brand LLC, operating under the brand name JMX. The terms “JMX,” “we,” “us,” and “our” refer to JMX Brand LLC.
JMX operates this website, online store, and all related information, content, features, tools, products, communications, and services, collectively referred to as the “Services.” Our online store is powered by Shopify, which provides the ecommerce platform that enables us to offer the Services.
Please read these Terms carefully. They contain important information regarding product purchases, health and wellness information, warranty disclaimers, limitations of liability, and your legal rights.
By visiting, accessing, browsing, submitting information, creating an account, making a purchase, or otherwise using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Services.
SECTION 1: ELIGIBILITY, ACCESS, AND ACCOUNTS
You must be at least the age of majority in your state or province of residence and legally capable of entering into a binding agreement to make a purchase through the Services.
The Services are not directed toward children under 13. Children under 13 may not create an account, submit personal information, or make purchases through the Services.
Certain products may be intended for adults only or may contain additional age restrictions, warnings, or directions. Every product must be purchased and used only in accordance with its label, suggested use, warnings, and applicable laws.
You may be asked to provide information such as your name, email address, telephone number, billing information, payment information, and shipping address. You represent that all information you provide is accurate, current, complete, and lawfully provided.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You must notify us promptly if you believe your account or payment information has been accessed or used without authorization.
You may not sell, transfer, assign, license, or provide your account credentials to another person.
We may refuse service, suspend an account, cancel an account, restrict purchasing privileges, or limit access when we reasonably believe doing so is necessary to protect JMX, our customers, our service providers, or the security and integrity of the Services.
SECTION 2: HEALTH INFORMATION AND NO MEDICAL ADVICE
Information provided through the Services, including product descriptions, ingredient information, articles, reviews, testimonials, social media content, educational materials, and other website content, is provided for general informational and educational purposes only.
JMX does not provide medical advice, medical diagnosis, medical treatment, pharmacy services, or emergency medical services. Nothing available through the Services is intended to replace advice from a physician or another qualified healthcare professional.
The Services do not create a physician patient, healthcare professional patient, pharmacist patient, or other professional healthcare relationship.
Customer service representatives may assist with general questions regarding products, orders, ingredients, labels, and website information, but they cannot provide personalized medical advice or determine whether a product is appropriate for your individual needs.
Do not disregard, avoid, or delay obtaining professional medical advice because of information that appears through the Services.
The Services and products should never be used as a substitute for emergency medical care. If you believe you are experiencing a medical emergency, call 911 or seek immediate emergency assistance.
SECTION 3: DIETARY SUPPLEMENTS, PRODUCT USE, AND SAFETY
Certain products offered through the Services are dietary supplements.
Statements made through the Services regarding dietary supplements have not been evaluated by the U.S. Food and Drug Administration. Products offered through the Services are not intended to diagnose, treat, cure, or prevent any disease.
Before using a product, carefully review the physical product label, Supplement Facts panel, ingredient list, suggested use, serving information, warnings, allergen information, storage instructions, and safety seal.
Always follow the directions and recommended serving shown on the physical product label. Do not exceed the recommended dose.
Consult a qualified healthcare professional before beginning any dietary supplement, especially if you:

If you experience an adverse reaction, discontinue use and seek appropriate medical guidance. For a serious or life threatening reaction, seek emergency medical assistance immediately.
Individual experiences and results vary. JMX does not guarantee that a product will produce any particular health, wellness, energy, sleep, relaxation, digestive, athletic, metabolic, weight management, cognitive, beauty, intimate wellness, or other outcome.
Your decision to purchase and use a product should be based on your individual circumstances, the physical product label, and guidance from a qualified healthcare professional when appropriate.
SECTION 4: PRODUCT INFORMATION, PACKAGING, AND AVAILABILITY
We make reasonable efforts to present product information accurately. However, product packaging, labels, colors, images, dimensions, appearance, ingredients, formulations, suppliers, and other details may be updated from time to time.
Product images may include digital renderings, product mockups, lifestyle photography, edited photography, or other visual presentations intended to display the product. Screen settings, devices, lighting, packaging updates, and production variations may cause a physical product to appear different from its website image.
The physical product label contains important current directions, ingredients, warnings, and safety information. Always review the physical label before use.
If you identify a material difference between the website information and the physical product label, do not use the product until you have reviewed the label and contacted us if clarification is needed.
Product descriptions, ingredients, packaging, pricing, availability, quantities, and formulations may be modified, replaced, suspended, or discontinued without prior notice.
We may limit sales or quantities by person, household, account, payment method, shipping address, geographic region, or jurisdiction.
Products are offered only where lawful. You are responsible for determining whether purchasing, possessing, importing, and using a product is permitted in your location.
SECTION 5: ORDERS
Submitting an order constitutes an offer to purchase the selected products under these Terms.
An automated order confirmation acknowledges that we received your order but does not necessarily constitute final acceptance. We may accept, reject, limit, hold, or cancel an order for lawful reasons, including:

Payment must be successfully authorized and processed before an order is fulfilled.
Review your products, quantities, flavors, shipping address, billing information, and payment details carefully before submitting an order. Orders may enter processing quickly, and we cannot guarantee that a cancellation, address correction, product substitution, flavor change, or other modification can be completed after submission.
If we cancel or materially modify an order, we will attempt to notify you using the contact information supplied with the order.
If JMX cancels an item or order because it cannot be fulfilled, cannot legally be shipped, or cannot be shipped within the required period without your agreement to a delay, the amount paid for the affected item or order will be returned to the original payment method when required by applicable law.
Other approved cancellation requests may be resolved through JMX store credit in accordance with our Refund Policy unless applicable law requires another remedy.
Purchases are intended for personal or household use or as bona fide gifts. Products may not be purchased for unauthorized resale, redistribution, export, or other commercial purposes without prior written permission from JMX.
We may cancel or restrict orders that appear to involve resellers, distributors, automated purchasing, discount manipulation, multiple accounts created to avoid restrictions, or other fraudulent or abusive activity.
SECTION 6: PRICES, BILLING, DISCOUNTS, AND PROMOTIONS
Prices, discounts, offers, promotions, and product availability may change without notice.
The price charged will ordinarily be the price displayed when the order is submitted, subject to correction of errors as permitted by applicable law.
Unless expressly stated otherwise, displayed prices do not include applicable taxes, shipping charges, customs charges, duties, or other fees.
You agree to provide current, complete, and accurate payment, billing, account, and contact information. You represent that you are authorized to use the payment method submitted with your order.
Payments may be processed by Shopify or another third party payment provider. Your payment may also be governed by the applicable provider’s terms and privacy practices.
Discount codes, promotional offers, rewards, referral credits, gifts with purchase, and other incentives:

May be subject to eligibility requirements, expiration dates, minimum purchases, exclusions, geographic restrictions, and usage limitations.

Have no cash value unless required by law.

May not be sold, transferred, copied, or reproduced unless expressly permitted.

May not be combined with another discount unless JMX expressly permits the combination.

May not apply to prior purchases.

May be canceled or revoked if obtained or used through fraud, false information, multiple accounts, technological manipulation, or other abuse.

May be governed by additional terms presented with the offer.
If specific promotional terms conflict with these Terms, the specific promotional terms will govern that promotion.
We may correct pricing, billing, discount, or promotional errors and cancel or adjust an affected order as permitted by law.
CHARGEBACKS AND PAYMENT DISPUTES
If you believe that an order, payment, subscription charge, refund, or other transaction contains an error, please contact JMX Support at support@jmxbrand.com when practical so that we may review the matter and attempt to resolve it.
Nothing in these Terms limits any right you may have under applicable law to contact your bank, card issuer, payment provider, government agency, or regulatory authority.
If a chargeback, payment dispute, inquiry, or similar claim is initiated, JMX may provide the payment processor, card issuer, bank, or other reviewing institution with information and documentation relevant to the transaction. This may include order and payment records, checkout information, applicable policies, subscription authorization, shipment tracking, delivery confirmation, account activity, refund or replacement records, customer communications, fraud-analysis information, and other evidence reasonably related to the dispute.
A chargeback does not automatically entitle a customer to retain both the purchased products and the disputed funds. JMX may contest a chargeback when our records indicate that the transaction was authorized, the order was properly fulfilled, a refund or other resolution was already provided, or the dispute is otherwise inaccurate or unsupported.
JMX may suspend or close an account, cancel pending orders or rewards, restrict future purchases, or refuse future service when we reasonably determine that a customer has engaged in fraudulent chargebacks, knowingly false disputes, repeated abuse of the payment-dispute process, or attempts to obtain products or benefits without payment.
This section does not apply to good-faith disputes, reports of genuinely unauthorized transactions, or the lawful exercise of consumer rights.
SECTION 7: SHIPPING, PROCESSING, AND DELIVERY
Orders may be processed, manufactured, packaged, or fulfilled with the assistance of third party providers.
Products contained in the same order may be prepared or shipped separately and may arrive in more than one package or on different dates.
Processing periods, shipping estimates, tracking information, and delivery dates are estimates only and are not guaranteed.
Delivery may be affected by carrier operations, weather, natural events, holidays, high order volume, incorrect addresses, security reviews, service interruptions, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed delivery, or additional costs resulting from incorrect, incomplete, outdated, or undeliverable information supplied by the customer.
Available shipping services, destinations, carriers, and rates are determined at checkout and may change.
Tracking information may take time to update after a shipping label is generated or a package is transferred to a carrier.
If an order appears lost, damaged, missing, or incorrectly delivered, contact JMX promptly and provide any requested order information, photographs, packaging details, or other documentation needed to investigate.
Additional information regarding processing, rates, delivery estimates, and shipping procedures appears in our Shipping Policy, which is incorporated into these Terms.
SECTION 8: RETURNS, REFUNDS, STORE CREDIT, AND THIRD PARTY PURCHASES
Returns, refunds, replacements, damaged products, incorrect products, missing products, cancellations, exchanges, and store credit are governed by our Refund Policy, which is incorporated into these Terms.
Due to the health, safety, and quality standards associated with ingestible supplements and personal wellness products, all purchases made directly from JMX are final.
JMX does not ordinarily accept returns or exchanges, including for unopened products, once an order has been processed or transferred to the fulfillment facility.
Opened, used, altered, tampered with, or unsealed products are not eligible for return, subject to applicable law.
Do not send a product to JMX, a manufacturer, a fulfillment provider, or an address shown on a package unless the return has been authorized in writing by JMX Customer Support.
For an approved damaged, defective, incorrect, or missing product claim, JMX will generally provide a replacement of the affected product at no additional charge.
If a replacement is unavailable or cannot reasonably be provided, JMX may issue store credit equal to the amount paid for the affected item.
Store credit is not transferable or redeemable for cash except where required by applicable law.
JMX does not issue refunds to the original payment method for buyer’s remorse, flavor or taste preferences, ordering mistakes, duplicate orders caused by customer error, personal expectations, individual product results, or other reasons excluded under the Refund Policy.
A refund to the original payment method will be provided only when required by applicable law. This may include circumstances in which JMX cancels an order because it cannot be fulfilled, cannot legally be shipped, cannot be shipped within the required period without the customer agreeing to a delay, or must correct a duplicate, unauthorized, or improper charge.
Products purchased through Amazon, TikTok Shop, another marketplace, a physical retailer, a third party website, or another independent seller are subject to that seller’s policies and procedures.
Requests involving third party purchases should be directed to the seller from whom the product was purchased.
JMX cannot issue a refund, replacement, exchange, or store credit for a transaction for which JMX did not directly receive payment unless expressly required by law or agreed to in writing.
SECTION 9: INTELLECTUAL PROPERTY
The Services and their contents, including the JMX name, logos, product names, packaging designs, photographs, renderings, graphics, videos, audio, text, illustrations, icons, software, layouts, product descriptions, slogans, and overall design and arrangement, are owned by or licensed to JMX and are protected by applicable intellectual property laws.
You may access and use the Services for personal, lawful, noncommercial purposes.
Except where expressly permitted in writing, you may not copy, reproduce, distribute, republish, modify, create derivative works from, display, transmit, sell, license, scrape, download, store, or commercially exploit any portion of the Services or JMX intellectual property.
Nothing in these Terms grants you ownership of or a license to any trademark, copyright, patent, trade dress, trade secret, or other intellectual property belonging to JMX, Shopify, or another party.
The JMX name, logo, branding, product names, packaging, designs, and slogans may not be used without prior written permission from JMX.
All rights not expressly granted are reserved.
SECTION 10: REVIEWS, TESTIMONIALS, FEEDBACK, AND USER CONTENT
The Services may allow you to submit reviews, photographs, videos, comments, testimonials, survey responses, suggestions, social media posts, or other content, collectively referred to as “User Content.”
By submitting User Content directly to JMX, through a review provider, through a form, through a promotional feature, or by intentionally tagging JMX in content intended to be shared with the brand, you grant JMX a nonexclusive, worldwide, perpetual, irrevocable, transferable, sublicensable, royalty free license to use, reproduce, edit, adapt, publish, translate, distribute, display, perform, and otherwise use that User Content in connection with JMX’s website, products, advertising, social media, email, public relations, and marketing.
You represent that:

You own the User Content or have all permissions required to submit it.

The User Content reflects your honest experience or opinion.

You have disclosed any free product, payment, discount, incentive, affiliate relationship, or other material connection associated with the submission.

The User Content does not violate another person’s intellectual property, privacy, publicity, contractual, or other legal rights.

The User Content is not fraudulent, deceptive, defamatory, threatening, abusive, discriminatory, obscene, unlawful, or malicious.

The User Content does not contain viruses, malware, or harmful code.
You remain responsible for your User Content.
Reviews and testimonials reflect individual experiences and opinions. They do not represent medical advice, clinical evidence, or a guarantee that another customer will experience the same result.
We may review, moderate, reject, edit for formatting, remove, or decline to publish User Content, but we are not required to monitor every submission.
We are not obligated to compensate you, treat User Content as confidential, publish it, retain it, or respond to it.
SECTION 11: OPTIONAL TOOLS AND THIRD PARTY SERVICES
The Services may include tools, applications, integrations, payment services, review platforms, fulfillment providers, social media features, analytics providers, advertising tools, or other services supplied by third parties.
We may not control or continuously monitor every third party tool. Unless expressly stated otherwise, third party tools are made available on an “as is” and “as available” basis.
Your use of a third party service may be governed by that provider’s own terms, policies, and privacy practices. You are responsible for reviewing those terms before using the service.
To the fullest extent permitted by law, JMX is not responsible for the independent availability, security, content, accuracy, operation, or conduct of third party services.
The Services may also contain links to independent websites. A link does not necessarily mean that JMX endorses, owns, or controls the linked company, website, product, or content.
Transactions conducted directly with an independent third party are between you and that third party.
SECTION 12: RELATIONSHIP WITH SHOPIFY
JMX is powered by Shopify, which enables us to provide the Services.
Any sales and purchases made through the JMX store are made directly between you and JMX.
By using the Services, you acknowledge that Shopify is not responsible for the manufacturing, labeling, marketing, fulfillment, shipping, quality, safety, use, or performance of products offered by JMX.
To the extent permitted by law, you release Shopify and its affiliates from claims arising directly from purchases and transactions between you and JMX.
Nothing in this section limits any right that cannot lawfully be waived.
SECTION 13: PRIVACY
Our collection, use, disclosure, retention, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms.
Because the Services are hosted by Shopify and use third party providers, information you submit may be processed by Shopify and other providers that help us operate the store, process payments, fulfill orders, provide customer service, prevent fraud, deliver marketing, analyze performance, and provide related functions.
Certain providers may process information in jurisdictions other than the jurisdiction where you live.
Your use of the Services is subject to the privacy choices, notices, and rights described in our Privacy Policy.
SECTION 14: EMAIL AND TEXT COMMUNICATIONS
You may choose to receive marketing emails from JMX. Marketing consent is not a condition of purchasing a product.
You may unsubscribe from marketing emails using the unsubscribe link contained in the message. Transactional and service related emails, including order confirmations, shipping notifications, security messages, and customer service responses, may still be sent when necessary.
If JMX offers text message marketing and you separately opt in, you consent to receive recurring promotional, marketing, transactional, or customer support text messages at the telephone number provided, including messages sent using automated technology where permitted.
Consent to receive marketing text messages is not a condition of purchase. Message frequency may vary. Message and data rates may apply.
You may opt out of marketing text messages by replying STOP. You may request assistance by replying HELP or contacting JMX.
Wireless carriers are not responsible for delayed or undelivered messages.
You represent that you are the authorized user of any email address or telephone number you provide and agree to notify us if your contact information changes.
SECTION 15: ERRORS, INACCURACIES, AND OMISSIONS
The Services may occasionally contain typographical errors, incorrect prices, inaccurate descriptions, outdated information, inventory errors, promotional errors, shipping errors, or omissions.
We may correct errors, update information, modify content, cancel an affected order, or take other reasonable corrective action at any time, including after an order has been submitted.
Nothing in this section limits obligations imposed by applicable consumer protection law.
SECTION 16: PROHIBITED USES
You may use the Services only for lawful purposes.
You may not use the Services to:

Violate any applicable law, regulation, rule, or ordinance.

Infringe or misappropriate intellectual property, privacy, publicity, contractual, or other rights.

Harass, threaten, abuse, impersonate, deceive, defame, discriminate against, or harm another person.

Submit false, fraudulent, misleading, or inaccurate information.

Upload or distribute malware, viruses, malicious code, or harmful technology.

Interfere with the security, availability, integrity, or operation of the Services.

Circumvent purchase restrictions, quantity limits, discount limitations, account controls, CAPTCHAs, access restrictions, or security measures.

Collect, track, scrape, harvest, or misuse personal information.

Send spam, phishing messages, unauthorized promotions, or unsolicited communications.

Use bots, automated scripts, scraping systems, autonomous agents, crawlers, or similar technology to access or interact with the Services without written permission.

Copy, resell, reproduce, exploit, or commercially use any portion of the Services without authorization.

Purchase products for unauthorized resale or redistribution.

Engage in conduct that could damage JMX, Shopify, a service provider, another customer, or the public.
We may investigate suspected prohibited activity and suspend or terminate access where reasonably necessary.
SECTION 17: TERMINATION
You may stop using the Services at any time.
We may suspend, restrict, or terminate your account, purchasing privileges, or access if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created a security risk, or acted unlawfully.
Termination does not eliminate obligations or amounts incurred before termination.
Provisions that by their nature should continue after termination will survive, including provisions concerning intellectual property, User Content, warranties, liability, indemnification, governing law, and unpaid obligations.
SECTION 18: DISCLAIMER OF WARRANTIES
THE SERVICES, WEBSITE CONTENT, AND PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, EXCEPT TO THE EXTENT JMX EXPRESSLY PROVIDES A WRITTEN WARRANTY OR APPLICABLE LAW REQUIRES OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY LAW, JMX DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON INFRINGEMENT.
WE DO NOT WARRANT THAT:

THE SERVICES WILL ALWAYS BE AVAILABLE, UNINTERRUPTED, SECURE, OR ERROR FREE.

WEBSITE INFORMATION WILL ALWAYS BE COMPLETE, CURRENT, OR FREE FROM ERRORS.

A PRODUCT WILL MEET EVERY INDIVIDUAL EXPECTATION.

USE OF A PRODUCT WILL PRODUCE A PARTICULAR RESULT.

ERRORS OR DEFECTS WILL ALWAYS BE CORRECTED IMMEDIATELY.
SOME JURISDICTIONS DO NOT PERMIT CERTAIN WARRANTY EXCLUSIONS. IN THOSE JURISDICTIONS, THE EXCLUSIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.
NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.
SECTION 19: LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY LAW, JMX BRAND LLC AND ITS OWNERS, MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, MANUFACTURERS, FULFILLMENT PROVIDERS, PAYMENT PROVIDERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, LOSS OF BUSINESS, LOSS OF OPPORTUNITY, OR REPLACEMENT COSTS, ARISING FROM OR RELATING TO:

YOUR USE OF OR INABILITY TO USE THE SERVICES.

YOUR PURCHASE OR USE OF A PRODUCT.

ERRORS OR OMISSIONS IN WEBSITE CONTENT.

UNAUTHORIZED ACCESS TO OR ALTERATION OF INFORMATION.

DELAYS OR FAILURES CAUSED BY THIRD PARTY SERVICES.

ANY OTHER MATTER RELATING TO THE SERVICES OR THESE TERMS.
TO THE FULLEST EXTENT PERMITTED BY LAW, JMX’S TOTAL AGGREGATE LIABILITY ARISING FROM A PRODUCT, ORDER, OR THE SERVICES WILL NOT EXCEED THE GREATER OF:

THE AMOUNT YOU PAID TO JMX FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM.

ONE HUNDRED U.S. DOLLARS.
THE LIMITATIONS IN THIS SECTION DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING LIABILITY FOR FRAUD, WILLFUL MISCONDUCT, OR OTHER MATTERS THAT APPLICABLE LAW PROHIBITS US FROM LIMITING.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIABILITY LIMITATIONS. IN THOSE JURISDICTIONS, THESE LIMITATIONS APPLY ONLY TO THE FULLEST EXTENT PERMITTED BY LAW.
SECTION 20: INDEMNIFICATION
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless JMX Brand LLC, Shopify, and their respective affiliates, owners, members, managers, officers, directors, employees, agents, contractors, licensors, and service providers from third party claims, losses, damages, liabilities, judgments, costs, and reasonable attorneys’ fees arising from:

Your material breach of these Terms.

Your unlawful or unauthorized use of the Services.

Your User Content.

Your violation of another person’s legal rights.

Fraudulent, abusive, or unlawful activity associated with your account.
We will provide reasonable notice of an indemnifiable claim. We may control the defense and settlement of the claim, and you agree to provide reasonable cooperation.
This section does not require a consumer to indemnify JMX for JMX’s own unlawful conduct where prohibited by law.
SECTION 21: GOVERNING LAW AND DISPUTES
These Terms and any dispute arising from them are governed by the laws of the State of California, without regard to principles concerning conflicts of law.
Nothing in these Terms deprives you of mandatory consumer rights that apply under the law of your state of residence.
Before initiating formal legal proceedings, you are encouraged, but not required, to contact JMX so that we may attempt to resolve the issue directly.

To the extent permitted by applicable law, any legal action arising from these Terms, the Services, an order, or a JMX product must be brought in the state or federal courts located in Riverside County, California.
You and JMX consent to the personal jurisdiction and venue of those courts.
This section does not prevent either party from bringing an eligible individual matter in small claims court or contacting a government or regulatory agency.
SECTION 22: SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the fullest lawful extent or severed from these Terms.
The remaining provisions will continue in full force and effect.
SECTION 23: WAIVER, ENTIRE AGREEMENT, AND ASSIGNMENT
A failure by JMX to enforce a provision of these Terms does not waive the right to enforce that provision later.
These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and additional terms presented in connection with a product, offer, promotion, or service, constitute the entire agreement between you and JMX regarding the Services.
These Terms supersede prior or contemporaneous communications and agreements concerning the same subject matter.
You may not assign or transfer your rights or obligations under these Terms without prior written permission from JMX.
JMX may assign or transfer these Terms and its rights and obligations in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or other lawful business transaction.
There are no third party beneficiaries to these Terms except where expressly stated.

We may update these Terms from time to time.
The current version will be posted on this page with an updated effective date.
If a change materially affects your rights, we will provide notice as required by applicable law.
Changes will apply prospectively from their stated effective date. Your continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms.
